1. Introduction

Welcome to Somnium.

These Terms & Conditions govern your use of the Somnium website and outline the general terms under which our services and digital products are presented and supplied.

Somnium is an independent creative studio operating across three areas: Create, Preserve and Experience. Our work includes creative media production, documentary filmmaking and the development of original digital products.

By accessing or using this website, you agree to these Terms & Conditions. If you do not agree with any part of these terms, please refrain from using the website.

In these terms, references to “Somnium”, “we”, “our” or “us” refer to the business operating under the Somnium name.

2. Our Services

Somnium operates across three principal areas:

Create

Our creative services include bespoke social media carousels, photography, video, animation, graphic design, motion graphics and digital media screen artwork.

Please note that our media screen services involve the creation of digital artwork and animations only. We do not supply, install or maintain physical screens or associated hardware unless expressly agreed in writing.

Preserve

Our documentary services include Wedding Documentary Packages and Life Stories. These services involve capturing, producing and editing personal stories, events, interviews and associated visual material.

Specific deliverables, production arrangements, timescales and pricing will be agreed with each client before work commences.

Experience

Somnium also involves the independent development and release of original web applications, mobile applications and other digital products.

These products are developed and owned by Somnium unless otherwise stated. They may be made available for purchase, subscription or download through our website or third-party platforms.

We do not offer commissioned application development as part of this service.

3. Website Use

You agree to use this website lawfully and responsibly.

You must not:

Use the website for any unlawful, fraudulent or malicious purpose.

Attempt to gain unauthorised access to the website or its systems.

Interfere with the website’s operation, security or functionality.

Copy, reproduce or distribute website content without permission.

Use the website in a way that could damage Somnium’s reputation or business.

4. Intellectual Property

Unless otherwise stated, all content displayed on this website belongs to Somnium or is used with the appropriate permission.

This includes, but is not limited to:

Photography and video content.

Graphic design and visual artwork.

Animations and motion graphics.

Website layouts and written content.

Branding, logos and visual identity.

Digital products and application concepts.

Other original creative materials.

You may not reproduce, distribute, modify, commercially exploit or otherwise use our intellectual property without prior written permission.

Purchasing a Somnium service or digital product does not automatically transfer ownership of the underlying intellectual property. Any usage rights or licensing arrangements will be outlined in the relevant project agreement or product licence.

5. Enquiries, Proposals and Bookings

Submitting an enquiry through our website does not constitute a confirmed booking or contractual agreement.

Where a client wishes to proceed with a service, Somnium will provide the relevant proposal, scope of work, pricing and any applicable project-specific terms.

A booking will only be confirmed once the agreed terms have been accepted and any required deposit or initial payment has been received.

Project-specific agreements will take precedence over these general website terms where the two conflict.

6. Pricing and Payments

Prices for Somnium services and digital products will be communicated through the relevant proposal, quotation or product listing.

Unless otherwise stated:

All payments must be made using the agreed payment method.

Any applicable deposits and payment schedules will be confirmed before work commences.

Additional work or changes outside the agreed scope may incur additional charges.

Any additional charges will be communicated and agreed before they are incurred.

Where applicable, prices will clearly identify whether VAT is included.

7. Cancellations, Refunds and Changes

Cancellation arrangements for creative projects and documentary services will be outlined in the relevant booking agreement.

Where a customer has statutory cancellation rights, these will be respected in accordance with applicable UK consumer legislation.

For digital products, refund and cancellation arrangements will be explained at the point of purchase. Nothing in these terms removes any statutory rights that customers may have.

Where a customer requests that a digital product or service is supplied immediately, any required consent and acknowledgement relating to cancellation rights will be obtained before supply begins.

8. Project Content and Client Responsibilities

For creative and documentary projects, clients are responsible for providing accurate information, relevant materials and any necessary permissions required for the project.

This may include:

Photographs, videos and archive footage.

Logos, branding and other supplied assets.

Permission to use third-party materials.

Relevant information and project instructions.

Appropriate consent from individuals being filmed, photographed or interviewed.

Clients must ensure they have the necessary rights and permissions to provide materials to Somnium for use within a project.

Somnium reserves the right to discuss alternative arrangements where supplied materials cannot be used for legal, technical or practical reasons.

9. Photography, Filming and Third-Party Suppliers

Some Somnium projects may involve collaboration with independent photographers, videographers, editors or other creative professionals.

Where third-party suppliers are involved, their responsibilities and contributions will be communicated as part of the relevant project arrangements. Somnium will make reasonable efforts to coordinate any agreed collaborative work.

10. Digital Products and Applications

Applications and digital products developed by Somnium may be subject to additional product-specific terms and licensing conditions.

Unless expressly stated otherwise:

Products are licensed for personal or business use as described at the point of purchase.

Users may not redistribute, resell, copy or commercially exploit our applications without permission.

Users must not attempt to reverse engineer, interfere with or gain unauthorised access to our products.

Features, functionality and compatibility requirements will be described within the relevant product information.

We may release updates, improvements and changes to our applications over time.

Any applicable subscription arrangements, renewal conditions and cancellation procedures will be displayed before purchase.
